VAKIM,
    While you are correct in saying that the Commander has a vote.  It is customary in our post for him not to vote unless to break a tie (which has never happened) at our post so as not to seem taking sides since he is supposed to be neutral.  Makes it easier for him to continue working with the losing side without grudges and go back to building bridges not walls.
Just my 2 cents worth.

Thanks for catching that Kim.  I  should of said, As commander, you need only to vote to break a tie on motions before the floor.   A commander should not make, second or debate motions as it is inappropriate.  As I may have said before, an umpire is suppose to be neutral.  He can not referee a game and be a player too.  It would not be fair to the other team.  
Every member has a right to exercise his vote. When a Commander casts his vote on motions verbally or by hand, those who are undecided may abstain or vote with you because of their faith in you or trust in you wisdom;  or against you because if your for it - they want to be against it.  That's the nature of some people.  Simply, a Commander must strive be fair and try not to render undue influence while holding the gavel.  Doing your best is all that matters.
Like IJK cheerily references,  A good commander builds bridges - not walls.

we had election last night i try to tell them we need notice sent out to alll the member
but the acting commander went a head with the election

It is appropriate for the membership to be informed by bulletin in advance when nominations and elections are being held,   But is mandatory when a vacancy is declared.

Sec 217 of By-Laws (Yellow) states the elective Post Officers shall be nominated, elected and installed as prescribed on the manual of procedure (MOP) .

Sec 217 MOP (White) states  Elected Post Officers shall be nominated at the first meeting in April. Where, by Post by-law or custom, a Post conducts only one regular meeting per month, elective post officers shall be nominated at the regular meeting in March.
   - ALSO -
The Installation of officers can NOT be held less than 20 days nor more than 60 days prior to the convening of the Dept Convention.   8)

Samuel for annual election of Post Officers you do not have to notify all member of the election in advance to the reguler scheduled meeting.

The question begs,  ???  "If it's is in your Post By-laws, then why didn't someone remind the membership and Commander at a Post meeting 2-3 months ago?"

Samuel,  Sec 217 of VFW By Laws and MOP mandates when the election will be held.  It can not be delayed without Departments approval. 

If your Commander failed do fulfill his duties and comply with your Post By-laws by reminding the membership in advance, but elections still had to take place. 

???  It is up to your post membership to decide if they want to hold the Commander and/or someone else accountable.  8)

  Well, I am sure glad that I stumbled upon this forum.  I have learned a great deal in a short period of time from all of you.

I have been nominated as Post Commander of Post 3127.  I think I will be relying much on the knowledge of my comrades both at my post and this forum. 

I hope I can justify the faith and confidence of my fellow comrades of my post and serve to enhance the VFW through membership drives and service to our community.

I am a Master Gunnery Sergeant USMC Retired.  I served from 1961 (May) until January 1991.  I will be checking this forum quite offen, as I have already gotton several ideas for our post.

Hope to see all the Southeast Missouri Comrades at the Doniphan VFW this Sunday.

Next Thursday is nominations and elections at my Post. So far it looks like we only have two positions that have multiple candidates. We are also going to elect deligates for the District and Department Conventions.

Last night was our last call and election.  We had only one person run for each of the elected positions.  That is sort of nice because it makes the voting process quick and easy.  However can be bad because if the majority disagrees with a nomination, and there is no one else willing, they will not oppose a unamious ballot.  I am curious.  It appears that some of you elect delegates for dist and dept functions and have that stand all year.  How do the rest of you do it.  Do you do it on a case by case?  Perhaps you have it in standing orders?  What about writing it into the bylaws? 

And by the way, last night I was elected Post Commander.  This is my first time in the position and plan on utilizing this forum as much as possible for advice and ideas.  I am greatfull that we have this forum as a resource to lean on.

Yes, congradulations Loadtoad. Does your Post have a "formal" (not formal dress) installation (dinner/dance type of thing) or do you have installation after a meeting and a party (or a dinner) sometime afterward?
